AHY's lawsuit is rejected by the panel of judges, Moeldoko's camp: Deli Serdang Democrat Party KLB is Legal
PD Chairman Agus Harimurti Yudhoyono's (AHY)'s lawsuit was rejected by the Central Jakarta District Court Legal Council. The lawsuit was directed against 12 members of the Deli Serdang extraordinary congress (KLB) for alleged unlawful acts.
In this regard, the spokesman for the Democratic Party for the Moeldoko camp, Muhammad Rahmad, said that the lawsuit was rejected because the AHY camp as the plaintiff had bad intentions because he had never attended the mediation session.
"They, as the plaintiffs, did not have good intentions because they never attended the mediation hearing," said Rahmad in his statement, Friday, August 13, 2021.
In this regard, he stated, the Moeldoko camp greatly appreciated the decision. Because it is proof that the accusations of the AHY camp against the Deli Serdang KLB are not proven and are just made up.
Rahmad also said that the decision was the key to winning the lawsuit for the validity of the Democrat Party KLB at the State Administrative Court (PTUN), East Jakarta.
"With this decision, all parties can witness that the implementation of the Democratic KLB in Sibolagit is legally valid," he continued.
In this regard, Rahmad asked all parties to realize that the management of the party bearing the star of mercy under the leadership of SBY and AHY was indeed problematic and violated the constitution.
The party's 2020 articles of association and by-laws, explained Rahmad, were made without the approval of members of the congress forum and were considered stealthy by including SBY as the founder of the party. "Even though according to the party's founding deed, SBY is not the founder of the party. his children became the sole rulers in the party," he explained.
It was said that the AD and ART of the party with the blue color also contradicted the ideals of the 1998 reform.
"It is also very contrary to the title that SBY holds as the Father of Indonesian Democracy. A democrat should be democratic, neither autocratic nor tyrannical," he said. Rahmad asked AHY's camp to accept the decision. His party also asked AHY to obey the law after the judge rejected his lawsuit. AHY's camp did not need to panic and make accusations. The court is the estuary for resolving legal issues. Therefore, let's respect it together," said Rahmad.
For this decision, Rahmad is optimistic that his side will win the State Administrative Court (PTUN). He believes the KLB decision will become valid in the PTUN.
"This decision, for us, is the key to winning the lawsuit for the validity of the Democratic Party KLB in the Administrative Court. With this decision, all parties can witness that the implementation of the Democratic KLB in Sibolagit is legally valid," said Rahmad. AHY's camp was also asked to obey the law if the Administrative Court accepted. Rahmad insisted that the election of AHY as general chairman was problematic and violated the existing constitution.
"The party's 2020 AD ART was made without the approval of members at the congress forum. It is a stealth AD ART that lists SBY as the founder of the party even though according to the party's founding deed, SBY is not the founder of the party. The 2020 AD ART also makes SBY and his children the sole rulers in the party," he said.
On the other hand, Moeldoko should be asked not to be too happy because AHY's lawsuit was rejected. According to Rahmad, victory has not yet arrived. Complete victory only comes when the Administrative Court's decision.
"Hopefully the panel of judges in the Administrative Court can see with a clear mind the serious problems that occur within the Democratic Party so that justice can truly be obtained by the DPP of the Deli Serdang KLB Democratic Party through the PTUN later," he said.
PPKM Ends September 13
