The Hindu Community Protection Foundation (YPUH) won a state administrative lawsuit against the Buleleng Regent. The Denpasar State Administrative Court (PTUN) stated that the issuance of the Buleleng Regent's Letter, which was used as the basis for sealing YPUH's crematorium, must be cancelled.
The state administrative problem began when the Regent of Buleleng Putu Agus Suradnyana signed a letter number 180/3704/HK dated December 28, 2021, regarding the termination of the implementation of the crematorium. The letter was used as the basis for the Buleleng Pol PP to seal the crematorium, which is located on Jalan Pulau Kalimantan, Kampung Baru Village.
A few weeks later, YPUH filed a lawsuit with the Denpasar Administrative Court. The lawsuit with number 7/G/2022/PTUN Denpasar was registered on March 9, 2022 by lawyer I Gede Arya Wira Sena.
The trial itself only started on April 4, 2022. After going through a trial process for several months, the panel of judges consisting of Chief Justice Simson Seran and member judges Retno Widowati and Dessy Anggraeni decided to win YPUH's lawsuit. The verdict was read last Friday (5/8).
In its decision, the panel of judges stated that the defendant's exception, in this case the Buleleng Regent, was not accepted in its entirety. The panel of judges also decided to grant the plaintiff's claim (YPUH) in its entirety.
Furthermore, the panel of judges declared the cancellation of the Buleleng Regent's Letter Number: 180/3704/HK dated December 28, 2021 Regarding: Termination of the Crematorium Implementation. The court also required the defendant to withdraw the letter. In addition, the defendant had to pay the court fees incurred in the amount of Rp 6,381,500.
The chairman of YPUH Buleleng Jro Mangku Nyoman Sedana Yasa when confirmed yesterday (15/8) said that the sealing of the crematorium from the beginning was carried out through unprocedural stages. He hoped the government would comply with the law and immediately cancel the letter.
If the decision is final, we hope that the government immediately cancels the letter that has been the basis for sealing our crematorium so far. So that the foundation can resume its activities as before,” he said.
He stated that all this time he was working for the benefit of the people. Moreover the activity has been going on for years. He assessed that the sealing, which was carried out at the end of 2021, actually harmed people who wanted to get their main service in the Pitra Yadnya ceremony. “We fulfill the people's demands and answer the people's needs. Hopefully the sealing letter will be lifted soon," he said.
Meanwhile, the Head of the Legal Division of the Buleleng Secretariat, Bayu Waringin, when confirmed, said that his party had submitted an appeal statement. The statement was submitted to the Denpasar Administrative Court clerk on Friday (12/8) to be forwarded to the Surabaya State Administrative High Court (PT-TUN).
